Due to the unique, hand-crafted nature and strict exclusivity of our Variable Limited Editions, all sales are final. Once a purchase is finalized, we cannot accommodate returns, cancellations, or exchanges based on a change of mind or personal aesthetic preference.
Damaged in Shipping? We’ve Got You Covered.
Your sculpture will be packed with the utmost care and shipped via UPS, Signature Upon Delivery, fully insured. In the rare event that your artwork is damaged during transit, we will gladly resolve the issue via a full refund or repair.
Because UPS enforces strict evidence criteria for damage claims, you must contact our studio within 48 hours of delivery and provide the following documentation:
Three (3) Required Photos: UPS requires specific photographic proof to approve an insurance claim. You must email us:
One photo showing the entire damaged box from the outside.
One photo showing the opened box with the internal packing materials (bubble wrap, foam, etc.) still inside.
One close-up photo showing the exact damage to the sculpture itself.
Keep the Box: Do not discard any of the original UPS shipping boxes or packing materials. UPS often requires a physical inspection of the packaging at the delivery address before they will release insurance payouts.
Note: Minor organic variations in the wood grain, texture, and hand-chisel marks are intentional features of hand-carved art and are not considered damages or defects.
Terms of Service
1. Order Cancellation
We reserve the right to refuse or cancel any order placed on MadelineBirds.com at any time and for any reason. Situations that may result in your order being canceled include, but are not limited to:
Inaccuracies or errors in product pricing or descriptions.
Limited quantities available for purchase or sudden stock depletion.
Problems identified by our credit and fraud avoidance department.
If your order is canceled after your payment method has been charged, MadelineBirds.com will issue a full credit to your original payment method in the amount of the charge. We will attempt to contact you via the email address provided at the time of purchase if any part of your order is canceled.
2. Shipping & Delivery
All purchases made through MadelineBirds.com are subject to our shipping policies:
Fulfillment: Shipping dates and delivery estimates provided at checkout are estimates only and are not guaranteed.
Transfer of Risk: Risk of loss and title for all physical items pass to you upon our delivery of the items to the shipping carrier.
Carrier Delays: MadelineBirds.com is not responsible for shipping delays, damaged packages, or lost shipments caused by the third-party shipping carrier, incorrect address entries, or severe weather events.
3. Ownership of Intellectual Property Protection
All content featured or displayed on MadelineBirds.com—including but not limited to text, graphics, logos, brand names, product designs, photographs, illustrations, digital downloads, software, and website code—is the exclusive property of MadelineBirds.com and is protected by United States and international copyright, trademark, and intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the site for personal, non-commercial shopping purposes only. Any unauthorized duplication, reproduction, modification, distribution, data scraping, or extraction of our intellectual property without prior written consent from MadelineBirds.com is strictly prohibited.
4. Governing Law & Dispute Resolution
These Terms of Service and any separate agreements whereby we provide you services shall be governed by, interpreted, and enforced in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles.
Any legal action, suit, or proceeding arising out of or relating to these Terms or your use of MadelineBirds.com must be brought exclusively in the state or federal courts located in the State of Texas, and you hereby consent to the personal jurisdiction of such courts.
